Near the end of Monday's Capital Region COG meeting, Hampden Township Commissioner Al Bienstock mentioned that COG has indeed filed its lawsuit (Link) against Pennsylvania's Department of Environmental Protection, and it is moving ahead.
Comm. Bienstock went on to say that he plans to personally approach each COG member municipality which decided not to join the lawsuit, and to appeal for it to reconsider in the interest of presenting a united front against DEP.
I wish the commissioner from our neighbor to the north well, but if I read my fellow LAT commissioners right, there is absolutely no interest whatsoever in joining the lawsuit. That said, the fact that no additional fees beyond the initial $2,000 would be expended in the suit without a municipality's approval may help soften our opposition.
Time, and Comm. Bienstock's spiel, may tell the tale.
